Preamble
For God and Country, we associate ourselves together for the following purposes:
To uphold the constitution of the United States of America. To maintain law and order, To foster and perpetuate a one hundred percent Americanism. To preserve the memories and incidents of our association in the great wars; To inculcate a sense of individual obligations to the community, state, and nation; To combat the autocracy of both the classes and the masses; To make right the master of might; To promote peace and goodwill on earth; To safeguard and transmit to posterity the principles of justice, freedom and democracy; To consecrate and sanctify our comradeship by our devotion to mutual helpfulness.

Article I-Name
Section 1. The name of the organizations shall be Mooresville American Legion #103, Inc. a corporation, Department of Indiana.
Article II-Mission Statement
Section 2. The objects and purposes of this post shall be to promote the principles and policies as set forth in the foregoing preamble, and the National Departmental Constitutions of the American Legion.
Article III-Nature
Section 1. Mooresville American Legion #103, Department of Indiana, is a civilian organization and membership therein does not affect or increases ones liability, for military and police service. Rank does not exist in the American Legion, no member shall be addressed by his or her military rank at any meeting of this post.
Section 2. Facilities, Canteen, adjacent properties owned by Mooresville American Legion Post #103 are available for use by all members of Mooresville Post #10e unless individual is under current restrictions. Areas needing reservations or any storage of items must be approved by house committee and if applicable, appropriate fees charged.
Section 3. Any members of other American Legion posts are welcomed at our post and must comply with rus of conduct.
Section 4. All guest must sign in by a member depending on current laws/regulations of the state of Indiana.
Article IV-Political Restrictions
Section 1. Mooresville American Legion #103, Department of Indiana shall be absolutely non-political, and shann not be used for the dissemination of partisan principles, or the promotion of the candidacy of any person, seeking public or post office, or preferment.
Section 2. Each Post Member shall perform their duty as a citizen according to their own conscience and understanding.
Section 3. By a favorable vote of membership, Candidates running for District, Department of Indiana or National office may receive Post #103 endorsement.
Article V-Membership Eligibility
Section 1. Any person shall be eligible for membership in the American Legion who was regularly enlisted, drafted, inducted or commissioned and who was accepted for and assigned to active duty in the Army, Navy, Marine Corp, Air Force and Coast Guard of the United States of America and assigned to active duty at some time during eligibility periods as set forth in the National Constitution of the American Legion all dates inclusive or who, being a citizen of the United States at the time of his/her entry therein, serving on active duty in the armed forces of any government associated with the United States during any said periods; provided however, that such service shall been terminated by honorable discharge or honorable separation and such person either shall have broken his continuity of service and returned to civilian status, or shall continue to serve honorably after the date of cessation of such hostilities as fixed ty the United States Government: provided, however, that no person shall be entitled to membership who being in such service during said periods, refuse on conscientious, political or other grounds to subject himself/herself to military discipline or unqualified service.
Section 2. No person shall be a member, at any time, of more than one Post of the American Legion.
Section 3. No person who has been expelled by an American Legion Post worldwide, shall be admitted to the membership in Mooresville American Legion Post #103 without Post Adjutant contacting prior Post's commander (for reason of expulsion) of the expelling Post.
Section 4. Membership Transfers must provide a copy of their proof of service; transfer paperwork must specify transferring post number, address and phone number. Post officer must validate character reference with old post prior to transfer being valid.
Article VI-Charter Members
Section 1. Members who joined American Legion prior to 11, November 1919 (or eligible members who joined this post prior to the issuance of charter, shall be known as Charter Members.
Article VII-Officers
Section 1. The elective officers of American Legion Post 103 shall be a, Commander, First Vice-commander, Second Vice-commander, Adjutant, Finance Officer, Chaplain, Sgt-at-arms, Judge Advocate, Service Officer, and historian, who shall be nominated during March and April regular business meeting and elected at the annual business meeting in May, for a term of one year, or until their successor have been duly elected/appointed and qualified. Voting will be conducted the day of regular business meeting in May from the hours of 10am-6:30pm. Absentee voting will be collected up to seven days prior to retular voting, forms must be collected by voting member at post and returned to post by voting member, absentee ballots e subject to all validations of membership as in regular voting. Voting and count verification shall be overseen by committee appointed by Commander.
Section 2. The office of any elected/appointed officer who shall be absent from three consecutive meetings, (committee or regular membership meetings) without good cause may be declared vacant and replace by the Commander after recommendation is voted on by membership at the next regular Post meeting. In the event the Post Commander position becomes open (removal, death, disciplinary action, etc.) then the 1st Vice Commander will temporarily fill the commander's position. The next regular post meeting will be advertised as commander election meeting, one round of nominations and voting by membership attending that meeting will elect Commander. Newly elected Commander will be installed that day.
